Villanova Athletic Fund (VAF) 50/50 Football Drawing Official Rules

1. The Villanova Athletic Fund (VAF) will conduct a 50/50 Drawing (the “Drawings”) at Villanova Stadium during each Villanova Football home game.

2. Each Drawing, and all tickets, transactions, participants, purchasers and winners are subject to these Official Rules, and to all applicable statutes, rules and regulations, including but not limited to the Pennsylvania Sports Raffle Charity Act (“the Act”), any and all rules and regulations adopted pursuant thereto, and all other applicable rules and regulations adopted by any regulator and/or enforcement agency having jurisdiction with respect to the activities to which these Official Rules apply.

3. No person who is under the age of eighteen (18) years old may purchase a Drawing ticket or claim any Prize (as defined below) related to the purchase or possession of a winning Drawing ticket. No person who is visibly intoxicated may purchase a Drawing ticket or claim any Prize (as defined below) related to the purchase or possession of a winning Drawing ticket. No person who has been convicted of a felony or a violation of the Pennsylvania Bingo Law, the Pennsylvania Local Option Small Games of Chance Act, the Pennsylvania Sports Raffle Charities Act, or any comparable federal or state law. Each ticket shall be purchased and belong to only one person, and only one person shall be entitled to claim the Prize (as defined below) associated with a winning ticket. If any dispute arises as to ownership of a Drawing ticket, the Villanova University Athletics Department, in its sole discretion, will determine ownership. By purchasing a Drawing ticket, the entrant agrees to abide by all terms of the Official Rules. Each Drawing is subject to all applicable federal, state, and local laws, rules and regulations. By entering any Drawing, entrants agree to abide by all terms of these Official Rules. All Drawings are subject to all applicable federal, state, and local laws, rules and regulations. Restrictions may apply. Void where prohibited or restricted by law.

4. Participating tickets for each Drawing will be sold throughout Villanova Stadium on the day of each Villanova Football home game. Ticket sales will commence as determined by Villanova University in its sole discretion but no later than the time the gates of the stadium open to the public. Ticket sales will conclude in the 4th Quarter of the Villanova Football home game or at the time at which a decision is announced that the game or its completion has been postponed to a later date or cancelled. Such sales shall be made only by credit card device presented by roaming Drawing sellers or presented at kiosks inside Villanova Stadium as follows: (a) five (5) tickets for ten dollars ($10.00); (b) twenty (20) tickets for twenty dollars ($20.00); one hundred tickets (100) tickets for fifty dollars ($50.00); and three hundred (300) tickets for one hundred dollars ($100.00). Each ticket amount purchased will represent that number of entries in that Drawing and is not eligible for any past or future Drawings. All Drawing ticket sales are final. Throughout the season, Villanova University has the right to change the price and/or number of tickets received for that price. All ticket/price information will be displayed on the kiosks and via the roaming sellers.

5. The Drawing jackpot running total is periodically displayed and updated in real time on the video boards inside the Villanova Stadium as well as via the televisions at both end zone locations. One (1) winning Drawing ticket will be randomly drawn by Villanova University utilizing an automated computer program during the 4th Quarter of such Villanova Football home game (or following the announcement of any postponement or cancellation of the game). The winning Drawing ticket number will be announced via the public address system during the 4th Quarter (or within fifteen minutes following any such postponement or cancellation announcement), and by posting the number on Villanova Stadium’s electronic sign boards from time to time, and by thereafter being posted for at least the next thirty days on the official Villanova University VAF 50/50 Drawings website (www.villanova.com/5050raffle). The winning Drawing ticket number will be posted on the official Villanova University VAF 50/50 Drawings website approximately 24-48 hours following the conclusion of such Villanova Football home game.

6. Each Drawing’s prize (the “Prize”) shall be half (50%) of the amount of the gross proceeds from the sale of tickets to such Drawing. The other half of the gross proceeds from the sale of tickets to the Drawing shall be retained by Villanova University, the VAF, and used to further its charitable ends as required by law. Prize winners will be subject to all applicable withholding tax and other federal, state, and local tax requirements. Each Drawing winner is advised to consult his/her own tax advisor(s) with respect to the liabilities that may arise from winning a Prize. No substitutes for a Prize are allowed by any potential Drawing winner.

7. In order to prove entitlement to any Prize (as defined above), the winning Drawing ticketholder for each game must appear in person and with a valid government issued photo ID and submit all documents required by these Official Rules to Villanova University at (a) the Guest Services Gazebo any time prior to thirty (30) minutes after the conclusion of the applicable home game, or (b) by appointment only at the offices of the Villanova University Athletics Business Department on or before the day that is thirty (30) days following the Villanova Football home game during which the winning ticket was drawn (the “Prize Claim Expiry Date”). To schedule an appointment, the winning Drawing ticketholder must contact the Villanova University Athletics Business Office by phone at 610-519-4115. If the Prize Claim Expiry Date occurs on a Friday, Saturday, or legal holiday, the Prize Claim Expiry Date is hereby deemed to occur on the next business day.

8. In order to prove entitlement to any Prize, the winning Drawing ticketholder for each game must submit to Villanova University in person and together with a valid government issued photo ID, the valid designated winning Drawing ticket, a completed 50/50 Drawing Publicity Release (the “Release”), and a Winning Ticket Claim Form (the “Claim Form”). Failure to produce the valid winning Drawing ticket together with the Release and the Claim Form will result in forfeiture of the related Prize.

9. The amount of the Prize, net of any withholding, if applicable, will be sent either via a check that is mailed via United States mail to the address of the Drawing winner or by direct deposit (deposited in the Drawing winner’s account) - within thirty (30) days after such Drawing ticketholder has submitted a valid government issued photo ID, valid the designated winning Drawing ticket, the Winning Ticket Claim Form, and the completed Drawing Publicity Release Form. The winner will also need to submit information online via Villanova University’s vendor onboarding platform so he/she can receive their Prize money and provide W-9 IRS Form data.

10. All Prizes not properly claimed on or prior to the applicable Prize Claim Expiry Date, noncompliance with these Official Rules, and all mailed Prize checks which are returned undeliverable, are hereby deemed forfeited, and any amount of such forfeited Prizes shall be retained by the Villanova University VAF to be used for its charitable purposes as required by law. Drawing winners may also choose to waive their right to receive a Prize (i.e. decline the Prize) at which time the Prize from that Drawing will be forfeited and the Prize will be retained by Villanova University VAF.

11. Villanova University is not responsible for lost or stolen Drawing tickets or tickets redeemed in error by their respective employees, members, or agents. Villanova University is not responsible for printing errors in any Drawing-related material or any misdirected, incomplete, late or illegible tickets or other errors or problems that may limit the entrant's ability to participate in or win any Drawing. False or deceptive entries or acts will render the entrant ineligible. Entrants may purchase as many tickets as they wish, subject to availability. No refunds will be made, except as otherwise determined by Villanova University in its sole discretion. Drawing ticket purchases are not tax deductible.

12. A Drawing ticket is void, and the holder thereof is ineligible to receive any Prize relating thereto, if there is sufficient evidence, in the sole discretion of Villanova University, that the ticket was stolen, improperly issued, ineligible, illegible, altered, counterfeited, or printed in duplicate or in error. Unauthorized persons copying, selling, or altering Drawing tickets or otherwise undermining the legitimate operation of a Drawing are subject to prosecution.

13. By purchasing a Drawing ticket, each ticketholder grants permission and agrees to have his or her name, address, biographical information, photograph, image, likeness, and voice published, broadcast, and otherwise reproduced by Villanova University Athletics in any media or format, worldwide, for publicity and promotional purposes, without notice, review, or approval and without further payment or consideration, for an unlimited duration.

14. Each Drawing ticketholder further waives any right to claim ambiguity in the operation of any Drawing or in these Official Rules. Each Drawing ticketholder agrees that Villanova University has made no representation, warranty, or guaranty, expressed or implied, in law or in fact, relative to the operation of the Drawings or to any Prizes, and is not responsible for any errors in the Official Rules, Drawing operations, Prizes or Drawing materials. A Drawing ticketholders' sole and exclusive remedy for any claim against Villanova University arising out of the sale of Drawing tickets or the conduct of the Drawing shall be limited to the return of the purchase price paid for his/her Drawing ticket(s). IN NO EVENT SHALL VILLANOVA UNIVERSITY OR ANY OF ITS EMPLOYEES, AGENTS OR CONTRACTORS BE LIABLE TO ANY PARTY OR DRAWING TICKETHOLDER FOR ANY LOSS OR INJURY TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15. Villanova University, in its sole discretion, reserves the right to disqualify any person tampering within the entry process or otherwise in violation of the Official Rules. Villanova University further reserves the right to cancel, terminate or modify the Drawing for any reason, including, but not limited to if any Drawing is not capable of completion as planned, including but not limited to, infection by tampering, unauthorized intervention or technical failures of any sort, fraud, or acts of God. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. These Official Rules will be governed by the laws of the Commonwealth of Pennsylvania, without reference to conflicts of law principles. Any controversy, claim or dispute arising out of or relating hereto shall be adjudicated in the Court of Common Pleas of Delaware County, Pennsylvania or the United States District Court for the Eastern District of Pennsylvania.
